Miami Airbnb Condo Checklist 2026: 7 Checks Before You List

Updated October 23, 2026. A Miami condominium advertised as “Airbnb-friendly” is not automatically eligible for nightly rentals. Before buying, furnishing or listing a unit, check its precise jurisdiction, association rules, permits and taxes. Platform availability is not proof of legal permission.

1. Verify the address and zoning

“Miami” can refer to the City of Miami, Miami Beach, another municipality or unincorporated Miami-Dade. Rules vary. The City of Miami zoning FAQ says rentals shorter than 30 days count as a lodging use and must satisfy zoning and the building's authorized use. Check the property's folio and seek written confirmation before spending money.

2. Miami Beach has different restrictions

The City of Miami Beach states that vacation rentals shorter than six months and one day are prohibited in all single-family homes and many multifamily buildings in certain zoning districts. Authorized properties require relevant city approvals, including a Business Tax Receipt and Resort Tax account; listings must display applicable city-issued numbers. Check the official zoning map and permitted-building information for the exact address.

3. Read the condominium and HOA documents

Even when local zoning allows vacation rentals, the condominium declaration, bylaws and leasing policies may impose minimum stays, guest registration, limits on frequency, insurance, parking or fees. Ask for current amendments and written association confirmation for the specific unit. Marketing claims such as “short-term rental approved” are not a substitute for documents.

4. Check the Florida DBPR license

Florida DBPR guidance, updated January 14, 2026, explains when condominium and other residential vacation rentals fall under the state's transient-lodging licensing rules, including units regularly advertised for stays shorter than 30 consecutive days or rented more than three times in a year for such stays. Confirm the classification, license and any exception directly with DBPR.

5. Understand the county's Certificate of Use

For properties in unincorporated Miami-Dade, Miami-Dade County describes an annual Certificate of Use, inspection and operating standards. The county specifically directs owners within municipalities to their city for local rules. A county certificate does not automatically authorize use in Miami Beach or other cities.

6. Confirm taxes and platform remittance

Short stays may trigger state sales tax and local tourist or resort taxes. Miami-Dade's tourist-tax guidance discusses registration, monthly returns and circumstances in which registered booking platforms collect and remit certain taxes. Direct bookings and multi-platform activity can change responsibilities. Verify the precise tax treatment with the authorities or an accountant; do not assume every platform handles every tax.

7. Budget for operations—not promised income

Calculate utilities, cleaning, internet, supplies, insurance, management, repairs, platform charges, taxes, vacant nights and any association fees. Decide who answers guests, handles emergencies, checks in visitors and maintains records. Nightly rates and occupancy fluctuate. No income or return is guaranteed.

Pre-listing checklist for owners

  • Confirm jurisdiction, zoning and permitted use by address.
  • Get current condo/HOA documents and written approval where needed.
  • Check city, county and DBPR permits and renewal dates.
  • Verify tax registration and platform collection arrangements.
  • Arrange suitable insurance, guest procedures and local support.
  • Keep approvals and records before accepting reservations.

Ask Get2Living about an owner partnership

Have a property in Miami-Dade or Broward? Request a no-obligation Airbnb owner partnership review to discuss eligibility, listing presentation and possible co-hosting responsibilities. Cleaning and on-site maintenance are not included in Get2Living's initial offering. Read how Get2Living works. Services and results depend on applicable rules and a separate written agreement.
